Nevada Co Sheriff Sicks DEA on
5-Patient Medical Marijuana Garden
Arraignment in Federal Court, Sacramento Oct
25th, 2 PM (Judge Carleton).
Nevada County, CA: In one of the
pettiest federal medical marijuana prosecutions to date ,
Michael Lombardo, 49. is facing criminal and forfeiture
charges for a modest 5-patient home garden in Smartville, CA.
Lombardo's home was raided by an armed DEA task force on Sept 13,
2007. Lombardo told them that he was growing for five Prop
215 patients, but was told that this didn't matter because it was a federal
raid. The DEA was called in by Nevada County Sheriff Keith
Royal in an evident attempt to circumvent state law, which allows cultivation
by medical cannabis collectives.
Lombardo says that he had 65 plants in the ground plus 20
more unrooted clones; however, he has been charged with growing
over 100 plants. In addition, the federal government has moved
to forfeit Lombardo's home, where he has lived for 7 years (state law
does not allow forfeiture for home marijuana cultivation).
In the past, many patients have been acquitted in state court for
growing over 100 plants under Prop 215. However, under federal
law, cultivation of over 100 plants is punishable by a 5-year mandatory
minimum. Lombardo is a union electrician and has
never had prior trouble with the law. He believes that his garden
was spotted by helicopters.
Califorenia NORML denounced the Nevada County Sheriff
for subverting state law. " The sheriff's salary is being paid for
by the people of California and he should enforce state laws, "said Cal
NORML coordinator Dale GIeringer, "It's an outrageous misuse of
law enforcement resources to be prosecuting patients for growing medical
marijuana for themselves."
The federal government has prosecuted scores of medical marijuana
patients in California since passage of Prop. 215, at a cost to the taxpayers
of millions of dollars. For a current list of federal
cases, see http://www.canorml.org/news/fedmmjcases.html
Lombardo says that a DEA agent told him to forget
about trying to plead innocent because no one would turn up to support
him in federal court. Supporters are invited to attend his arraignment
in federal court in Sacramento on Oct 25th at 2 PM before Judge Carleton.
Michael Lombardo can be contacted directly at (530) 432-6738.
- Dale Gieringer, California NORML
that would like one person's vote (namely your own vote) to be a
tiebreaker, and where improvements such as better rules or better
cabinet members get implemented on an ongoing four year cycle
timed with US presidential elections in 2008 and 2012?
The Free Parliamentary Party holds one single vote "yes". We know
we can't win US President or US Vice President in the real US elections.
So we're trying to build a 100 member coordinating board of directors,
and perhaps at least register more voters of all possible partis/categories.
A team of 100 equal units, elected with 1% each under pure proportional
representation, on which to build a smooth running voting block for the future
voting registration drives.
By integrating insiders and outsiders,
armchair activists and those with fresh legs ... all that matters,
is rankings on a ballot.
The voters' rankings are kept available as proof, are guaranteed to elect 100 "seats"
with plenty of back-ups, and this is known as the Sainte-Lague parliament
seat distribution system.
Each of the 100 splinter groups' members gel from top down,
and from bottom up, no matter where the position, each one
does small things for the good of the all, and weilds 1% of the "power".
Everybody likes what everybody does, as far as we can tell.
Our final elected slate will be a tie at two (one president + one vice president = two).
We also elect a majority ruling coalition who approves the rules and who elects the
five member executive. We must search and find the best MPs who wish to cast their
"MPs' vote" to shape and guide the executive through 2012, by ranking names
from more than 100 choices on a ballot. All current 100 MPs' seats are up for election
in 2008.
The five elected executives (three prime ministers and two secretaries)
are to be rotated in and out over the same four year period. Not just for accountablitity,
but also for continual improvements. And in cases of more ties,
the more active MPs are asked, and expected, to vote and break the ties.
Currently, ties in the collections of votes have bogged down the three
elected 100 member parliaments (national, California
and Central-Cal), despite the ongoing
rejuvination and a steady expansion of membership.
To remain dynamic, we need at least one more person who wants
to vote via internet, mail, phone, (however) ...
whatever it takes to work as one of 100, to break ties
on both the 100 member BoDs and their executives,
and to serve as backup names in cases of resignation or death.
If you are an elected member (MP, MSP or MMP) who wants help
in voting please don't hesitate to email or call the volunteer web designers
and/or vote counters to get free help. (530) 589.5294
It is our goal to implement the proposed all new members'
free services and have them ready, by 1/1/2008.
We look forward to seeing your vote, and we look forward to
hearing from you. We welcome your ideas and/or suggestions
for improvements, and we thank you for your interest.
